You can also bet that Google will have implemented an alogrithm that will allow the GoogleBot to identify sites breaking this guideline so that they can penalise them in the SERPs.

And what software do you use to place the picture(s)? Or do you just "hardcode" it in HTML?

Yes, hardcoded into the page layout. But given Google's new position on this matter I'm looking at removing them on sites I've used that technique on.
